Issued in compliance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules, regulations, privacy policies, and Terms of Use for accessing or using the domain name [www.merailaaka.com] ("Website"), including the associated mobile site and mobile application (hereinafter referred to as the "Platform").

 

The Platform is the property of ONESIMUS SOLUTIONS PRIVATE LIMITED, with its registered office located at BAZAAR ROAD, VILLAGE- DOMCHANCH, POST- DOMCHANCH, DISTRICT- KODERMA, STATE- JHARKHAND (825418) (hereinafter referred to as "Mera iLaaka").

 

Your utilization of the Platform, along with its services and tools, is subject to the subsequent terms and conditions ("Terms of Use"), as applicable to the Platform, encompassing the relevant policies that are integrated herein by reference. Should you engage in transactions on the Platform, you will be bound by the policies applicable to that transaction. The act of using the Platform establishes a contractual agreement with ONESIMUS SOLUTIONS PRIVATE LIMITED, and these terms and conditions, along with the policies, constitute your obligatory commitments with Mera iLaaka.

 

In the context of these Terms of Use, whenever necessary, the terms "You" or "User" pertain to any natural or legal person who has consented to become a customer on the Platform by furnishing Registration Data during the registration process as a Registered User using computer systems. Mera iLaaka enables Users to browse the Platform or make purchases without registering. The terms "We," "Us," "Our" denote ONESIMUS SOLUTIONS PRIVATE LIMITED.

 

When availing any services offered by Us through the Mera iLaaka Platform, encompassing, but not restricted to, services like Product Reviews and Vendor Reviews, you are bound by the rules, guidelines, policies, terms, and conditions specific to each service. These regulations are considered integral to and are deemed to be incorporated into these Terms of Use.

 

We retain the sole discretion to alter, amend, append, or withdraw portions of these Terms of Use without prior written notice. It is incumbent upon you to periodically review these Terms of Use for any updates or modifications. Your continued use of the Platform subsequent to any changes signifies your acceptance and agreement to the revised terms. Adherence to these Terms of Use grants you a personal, non-exclusive, non-transferable, and limited privilege to access and utilize the Mera iLaaka Platform.

Accessing, browsing, or engaging in any form of usage on the site signifies your consent to abide by all the terms and conditions outlined in these Terms of Use. Therefore, it is essential to thoroughly read and understand the terms before proceeding.

 

By either implicitly or explicitly acknowledging these Terms of Use, you concurrently agree to be bound by the policies of Mera iLaaka including, but not confined to, the Privacy Policy available at [Privacy] with amendments made periodically.

 

Acknowledgment

Following are the Terms and Conditions governing the use of the services of the platform (‘Mera iLaaka’: app or website) and the agreement that operates between users (Vendors, Customers) and US. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Services.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and other who access or use the services.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

 

User Accounts

When You create an account with Us You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on our Service.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

 

 

 

 

Content

Users’ right to Post Content in the form of pictures of the products sold or displayed by them.

 

Users are responsible for the Content that they post on the platform, including its legality, reliability and appropriateness.

By posting Content to the Service, Users grant Us the right and license to use, modify, publicly reform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post, or display on or through the Service and You are responsible for protecting those rights. YOU agree that this license includes the right for Us to make Your content available to other users of the service, who may also use Your Content subject to these Terms.

This license does not include any resale or commercial use of this platform or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining; robots or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of IRCPL.

All Customers have to register and login for placing order or viewing the products on the platform. You have to keep your account and registration details current and correct for communications related to your purchases from the platform. By aggreging to the terms and conditions, the shopper/ users/customers agree to receive promotional communication and newsletters upon registration. The customer can opt out either by unsubscribing in “My Account” or by contacting the customer service.

Pricing all the products listed on the platform will be sold at MRP unless otherwise specified. The prices mentioned at the time of ordering will be the prices charged at the time of delivery. Although prices of most of the products do not fluctuate on a daily basis but some of the commodities and fresh food prices do change on a daily basis. In case the prices are higher or lower at the time of delivery, no additional charges will be collected or refunded as the case may be at the time of the delivery of the order.

 

Cancellation by platform/ Customer

You as a customer can cancel your order anytime up to the cut-off time by calling the vendor. In such a case you will be refunded any payment already made by you for the order. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms and conditions of using the Platform, we at our sole discretion could cancel such orders. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

 

 

Return & Refunds

We have a “no questions asked return and refund policy” which entitles all our users to return the product at the time of delivery if they are not satisfied with the products in any proportion. The vendor will be issued a credit note for the value of the returned product which will be credited to your account on the site. The vendors and the customers will have to sort out the return and refund situation on their own in case of offline payment done by the customers by going to the physical store of the vendor. We have no obligation to sort out this situation.

 

Disclaimers

The Platform is subject to continuous upgrades, and certain functions and features may not be entirely operational during these updates.

Given the inherent uncertainties in the electronic distribution of information and the challenges associated with presenting data from diverse sources, the content provided on the platform may experience delays, omissions, or inaccuracies. Additionally, there might be delays or errors in the functionality of the Platform. Consequently, we cannot assert that the information posted is invariably accurate in every instance.

 

Delivery Executive Policy:

 

  1. Introduction:

Our platform only facilitates the connection between vendors and customers, providing a space for seamless transactions. In this context, vendors play a crucial role in managing the delivery process, including the assignment and verification of delivery executives. This policy outlines the responsibilities and expectations associated with this process.

 

  1. Assignment of Delivery Executive:

Vendor Responsibility: Vendors are responsible for assigning a competent and reliable delivery executive for each order.

Verification: Vendors must ensure that the assigned delivery executive is legitimate, possesses the necessary credentials, and is fit for the task.

 

  1. Verification Process:

Document Verification: Vendors should conduct thorough background checks, including the verification of identification documents, driving license, and any other relevant certifications.

Interview: Vendors are encouraged to interview potential delivery executives to assess their suitability for the role.

Training: Vendors should provide necessary training to delivery executives to ensure they understand the platform's policies and customer service standards.

 

  1. Responsibilities of Delivery Executives:

Professional Conduct: Delivery executives are expected to maintain a high level of professionalism and adhere to all relevant laws and regulations.

Verification: Delivery executives should carry and present their identification and other necessary documents when required.

 

 

 

  1. Communication:

Vendor-Customer Communication: Vendors should ensure clear communication with customers regarding the assigned delivery executive, including name and expected arrival time.

Emergency Contact: Provide a helpline or emergency contact for customers in case of any concerns about the delivery executive.

 

  1. Contingency Planning:

Replacement Policy: In the event of unforeseen circumstances preventing the assigned delivery executive from fulfilling their duties, vendors should have a policy for prompt replacement.

Customer Communication: Vendors must communicate any delays or changes in the delivery executive promptly to customers.

 

  1. Compliance:

Legal Compliance: Ensure that the assignment and verification process complies with all applicable laws and regulations.

Data Protection: Implement measures to protect the personal information of delivery executives and customers.

 

  1. Policy Updates:

This policy may be subject to periodic updates to reflect changes in regulations, industry standards, or platform requirements. Vendors will be notified of any such updates.

By participating in our platform, vendors agree to abide by this Shipping Executive Policy. Failure to comply may result in penalties, including suspension from the platform.

 

Legal and Law Enforcement Situations Policy:

In the event of any law and order situation arising due to the conduct of a delivery executive, the responsibility and onus rest solely on the head of the vendor. Mera iLaaka, as the platform connecting vendors and customers, is not liable for any legal implications, disputes, or consequences resulting from the actions or behavior of the vendor's assigned delivery executive.

Vendors are expected to ensure that their delivery executives adhere to all local, regional, and national laws and regulations. Any legal consequences, including but not limited to arrests, fines, or penalties, arising from the conduct of the delivery executive, will be the responsibility of the vendor. Mera iLaaka will cooperate with law enforcement authorities and provide any necessary information, but the vendor shall bear the legal consequences.

This policy underscores the importance of thorough verification, training, and monitoring by vendors to guarantee the professionalism and legality of their delivery executives. Mera iLaaka encourages vendors to implement robust procedures to prevent any situation that may lead to legal complications.

By engaging with Mera iLaaka's platform, vendors explicitly acknowledge and accept this Legal and Law Enforcement Situations Policy. Failure to comply may result in penalties, including the suspension of vendor privileges on the platform.

 

Shoppers/customers agree:

That in the event of a non-delivery due to a mistake by you (a wrong address or name or any other wrong information) any extra cost incurred by the vendor for redelivery shall be claimed from you.

That you will use the services provided by the platform, its affiliates, consultants, and contracted companies for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Platform.

You will provide authentic and true information in all instances where such information is requested of you. If upon confirmation your details are found not to be true (wholly or partially), we have the right in our sole discretion to reject the registration and debar you from using our platform without prior intimation whatsoever. You also authorize Vendors or employees of Mera iLaaka to remove the listed products if found false, duplicate, or illegitimate in any way.

Vendors will have to use an authentic picture of the products which should be clearly described wherever required. The images should be clear enough to not have difficulties for the customers while shopping or viewing the products. 

Users/Customers are accessing the services on this platform and transacting at their sole risk and are using their best and prudent judgment before entering into any transaction through this platform.

The address provided by the users/customers should be correct and in case of the wrong address is given, delay in delivery should be tolerated by the users and no complaints regarding this shall be entertained.

The Vendors, if, have opted for providing delivery of goods, they should ensure that the delivery executive is properly verified, he should be professional in the conduct of his duties, he should be trained, and should be aware of the region and locality in which he will be performing his job. Any misconduct on behalf of the delivery executive will be handled by the Vendor/Vendor and he will be held responsible for the further process of shorting out the issue. If a complaint is made to the customer care wing of Mera iLaaka, We, without any warning, will debar the services availed by the Vendor and delete his profile from the platform.

Vendors should make every effort to display the colors of the products that they upload on the platform as accurately as possible. However, the actual colors users see will depend on their monitor.

Platform for Transactions and Communication

The Mera iLaaka Platform serves as a medium through which users can connect and engage with each other for their transactions. ONESIMUS SOLUTIONS PRIVATE LIMITED is not and cannot act as a participant in or control any transaction between the users on the Platform.

Henceforth:

All commercial and contractual terms are solely negotiated and agreed upon between Customers and Vendors. This encompasses, but is not limited to, aspects such as price, shipping costs, payment methods, payment terms, delivery details, warranties related to products and services, and after-sales services. Mera iLaaka does not exert control, determine, or advise on these commercial and contractual terms. Discounts and offers, including exchange offers, are provided by the Vendor/Brand, not by Mera iLaaka.

The placement of an order by a Customer with a Vendor on the Platform is considered an offer to purchase the product(s) in the order. It is not construed as the Vendor's acceptance of the Customer's offer. The Vendor retains the right to cancel any such order at its discretion, with the Customer being notified through email/SMS. In the event of cancellation, any transaction price paid by the Customer will be refunded.

Mera iLaaka does not provide any representation or warranty regarding the specifics (quality, value, salability, etc.) of the products or services offered on the Platform. It does not endorse or support the sale or purchase of any products or services on the Platform and accepts no liability for any errors or omissions.

Mera iLaaka is not responsible for any non-performance or breach of contract between Customers and Vendors. The platform does not guarantee the performance of any transaction, and We are not obligated to mediate or resolve disputes between Users.

The platform does not make any representation or warranty regarding the item-specifics (legal title, creditworthiness, identity, etc.) of its Users. Users are advised to independently verify the credentials of any User they choose to deal with on the Platform.

We do not, at any point during a transaction, take possession of the products or services offered by Vendors, nor does it gain title or have any rights over them. It does not hold any right, title, or interest in the products and is not responsible for the performance of services or delays as a result of products being out of stock, unavailable, or back-ordered.

The Platform acts as a communication tool for Users to expand their reach in buying and selling products or services. The contract for the sale of any products or services is strictly between the Vendor and the Customer. We have no right, title, or interest in the products and holds no obligations or liabilities in the contract between Customers and Vendors.

At no juncture shall Mera iLaaka possess any right, title, or interest in the products. Mera iLaaka bears no obligations or liabilities concerning such contracts.

Mera iLaaka holds no responsibility for unsatisfactory or delayed service performance, damages, or delays resulting from products that are out of stock, unavailable, or back-ordered.

Users are expected to independently establish the manner, terms, and conditions of delivery, payment, insurance, etc., with the sellers they transact with.

If the customers are not satisfied with the product in any way, they can go to the physical store of the vendor and sort out the issue in ways customers do in local shopping. We have no role to play in such or similar situations.

 

Charges

Registration on the Platform remains free for the Customers. We will charge fee for vendors to access premium features. Mera iLaaka does not charge any fee for browsing and buying on the Platform. Mera iLaaka reserves the right to modify its Fee Policy from time to time. Particularly, Mera iLaaka may, at its sole discretion, introduce new services and adjust some or all of the existing services offered on the Platform. In such an event, Mera iLaaka reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. Changes to the Fee Policy will be posted on the Platform, and they will automatically become effective immediately after posting. Unless otherwise stated, all fees shall be quoted in Indian Rupees. Vendors shall be solely responsible for compliance with all applicable laws, including those in India, for making payments to ONESIMUS SOLUTIONS PRIVATE LIMITED.

Use of the Platform

You agree, undertake, and confirm that your use of the Mera iLaaka Platform shall strictly adhere to the following binding principles:

You shall not host, display, upload, modify, publish, transmit, update, or share any information which:

(a) belongs to another person and to which you do not have any right;

(b) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful;

(c) is misleading;

(d) is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred, or physical harm;

(e) harasses or advocates harassment of another person;

(f) involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing or "spamming";

(g) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous;

(h) infringes upon or violates any third party’s rights, including intellectual property rights, rights of privacy, or rights of publicity;

(i) promotes an illegal or unauthorized copy of another person’s copyrighted work;

(j) contains restricted or password-only access pages, hidden pages, or images;

(k) provides material that exploits people in a sexual, violent, or otherwise inappropriate manner or solicits personal information;

(l) provides instructional information about illegal activities;

(m) contains video, photographs, or images of another person;

(n) tries to gain unauthorized access to the Platform or exceeds the scope of authorized access;

(o) engages in commercial activities and/or sales without our prior written consent;

(p) solicits gambling or engages in any gambling activity;

(q) interferes with another user’s use and enjoyment of the Platform;

(r) refers to any Platform or URL that, in our sole discretion, contains inappropriate material;

(s) harms minors in any way;

(t) infringes any patent, trademark, copyright, or other proprietary rights;

(u) violates any law;

(v) deceives or misleads the addressee/users;

(w) impersonates another person;

(x) contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource;

(y) threatens the unity, integrity, defense, security, or sovereignty of India or causes incitement to the commission of any cognizable offence;

(z) shall not be false, inaccurate, or misleading.

(aa) You are prohibited from engaging, either directly or indirectly, in the offering, attempting to offer, trading, or attempting to trade any item that is restricted or prohibited under the current laws, rules, regulations, or guidelines.

(ab) Your actions should not result in liability for us or lead to the loss of services, either wholly or partially, from our internet service provider ("ISPs") or other suppliers.

(ac) You are prohibited from employing any automated device, program, algorithm, or methodology, including but not limited to "deep-link," "page-scrape," "robot," or "spider," to access, acquire, copy, or monitor any part of the Platform or its content. Any attempt to reproduce or bypass the navigational structure or presentation of the Platform, or to obtain materials, documents, or information through unauthorized means, is strictly forbidden. We reserve the right to prohibit such activities.

(ad) Unauthorized access attempts to any part of the Platform, connected systems or networks, or services offered through the Platform by hacking, password "mining," or any other illegitimate means are strictly prohibited.

(ae) You are not permitted to probe, scan, or test the vulnerability of the Platform or any connected network, breach its security or authentication measures, or engage in reverse look-up, trace, or seek to trace information about other users, visitors, or customers of the Platform. Exploiting the Platform or its services to reveal information other than your own is strictly prohibited.

(af) Negative, denigrating, or defamatory statements or comments about us, the brand name, or domain name, including terms like Mera iLaaka, are strictly prohibited. Any conduct that might tarnish the image or reputation of Mera iLaaka, its sellers, or dilute its trade or service marks is not allowed. You agree not to take actions that unreasonably burden the Platform's infrastructure or Mera iLaaka's systems, networks, or those connected to Mera iLaaka.

(ag) Using any device, software, or routine to interfere with the proper functioning of the Platform, ongoing transactions, or another person's use of the Platform is strictly prohibited.

(ah) You must consistently ensure strict compliance with the relevant provisions of the Information Technology Act, 2000, and its applicable rules, as amended. Additionally, you are obligated to adhere to all applicable domestic laws, regulations, and rules, encompassing but not limited to Exchange Control Laws or Regulations in force. This extends to international laws, foreign exchange laws, statutes, ordinances, and regulations, covering aspects like Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, and Local Levies, in connection with your utilization of our service and your activities such as listing, purchase, solicitation of offers, and sale of products or services. It is imperative that you refrain from participating in any transaction involving items or services that are prohibited by the provisions of any prevailing law, including exchange control laws or regulations.

(ai) Periodically, you are accountable for furnishing information regarding the products or services you intend to sell. In doing so, you commit to ensuring the accuracy of all provided information. It is essential not to exaggerate or overemphasize the attributes of your products or services in a manner that could mislead other users. Accuracy and transparency in presenting information are crucial for maintaining trust and facilitating fair interactions within the platform.

(aj) You are prohibited from engaging in advertising or solicitation directed at other users of the platform for the purpose of buying or selling products or services. This includes, but is not limited to, products or services related to those displayed on the platform or connected to us. Sending chain letters or unsolicited commercial or junk email to other users via the platform is also not allowed. Utilizing information obtained from the platform to harass, abuse, or harm another person, or to contact, advertise to, solicit, or sell to another person without our explicit consent, is considered a violation of these Terms of Use.

To safeguard our users from unwanted advertising or solicitation, we retain the right to limit the number of messages or emails a user may send to others in any 24-hour period, as deemed appropriate in our sole discretion. It is important to recognize that we have the right to disclose information, including the identity of individuals providing information or materials on the platform, as necessary to comply with any law, regulation, or valid governmental request. This may involve disclosing information in connection with the investigation of alleged illegal activity, solicitation of illegal activity, or in response to a lawful court order or subpoena. Additionally, we may, at our sole discretion, disclose information about you to law enforcement or other government officials if deemed necessary or appropriate in connection with the investigation and/or resolution of potential crimes, particularly those involving personal injury.

(ak) While we reserve the right to monitor materials posted on the Platform, we are under no obligation to do so. This platform retains the right to remove or edit any content that, in its sole discretion, violates or is alleged to violate any applicable law or the spirit and letter of these Terms of Use. However, it is crucial to note that you, as the user, remain solely responsible for the content of the materials you post on the Platform and in your private messages.

It is important to understand that the content posted does not necessarily reflect the views of Mera iLaaka. Under no circumstances shall Mera iLaaka assume or bear any responsibility or liability for any content posted or for any claims, damages, or losses resulting from the use of content and/or the appearance of content on the Platform.

By posting content, you represent and warrant that you have all necessary rights to the provided content and the information it contains. Furthermore, you assert that such content shall not infringe on any proprietary or other rights of third parties, nor does it contain any libelous, tortious, or otherwise unlawful information.

Platform Content Usage Guidelines

All the words, pictures, logos, sounds – everything you see or hear (let's call it "Content") on the Platform – is made by users, not Mera iLaaka. We're just here an intermediary to connect you all. We don't control what users create.

Here are some rules: don't copy, reproduce, or spread any part of the Platform or Content without our written permission. However, if we provide info about products or services, feel free to download it – just for your personal use. Keep it to yourself, don't change it, and don't claim it as yours.

Anything you post – notes, messages, pictures (let's call it "Content") – becomes ours. You're giving us the right to use it however we want, forever. It might end up in ads, promotions, or wherever. But you won't get paid for it.

Not everything on the Platform is suitable for everyone. Use your judgment. Parents, keep an eye on what your kids are checking out here.

Selling Guidelines

As a registered seller/vendor, you have the privilege to showcase your items for sale on the Platform, abiding by the Policies incorporated into this Terms of Use. Ensure that you possess the legal authority to sell the listed item(s). It is your responsibility to confirm that the items listed don't violate the intellectual property, trade secrets, or other rights of third parties regarding publicity or privacy.

Your listings should include accurate text descriptions, graphics, and images representing the items for sale. Keep all listed items in stock to fulfill successful sales. The item description must be truthful, reflecting the actual condition of the product. If there's a mismatch, you commit to refund any received amounts to the Customer.

Avoid listing the same product in multiple categories. Mera iLaaka reserves the right to remove such duplications to maintain a fair marketplace.

Payment Terms

In utilizing any payment method available on the Platform, we disclaim any responsibility or liability for any direct or indirect loss or damage to you due to:

  • Lack of authorization for any transaction/s,
  • Exceeding the preset limit agreed upon by you and the respective bank/s,
  • Any payment issues arising during the transaction,
  • Decline of a transaction for any other reason/s.

All payments for purchases/services on the Platform must be made in Indian Rupees acceptable in the Republic of India. Transactions in any other currency are not facilitated on the Platform.

Prior to shipping/delivering your order, the seller may request supporting documents (e.g., Government-issued ID, address proof) to verify ownership of the payment instrument used, ensuring a secure online shopping environment.

Additional Points:

Transactions and commercial terms (delivery, dispatch, etc.) are bilateral obligations between the customer/customer and seller/vendor.

The payment facility is a tool for transaction completion and does not make Mera iLaaka liable for issues like non-delivery, non-receipt, damage, or fraud related to listed products/services.

You authorize Mera iLaaka to collect, process, facilitate and remit payments electronically on behalf of users.

Your relationship with Mera iLaaka is on a principal-to-principal basis, and Mera iLaaka is not liable for the products or services listed on the Platform.

The payment facility provided by Mera iLaaka is not a banking or financial service but an electronic payment and collection facilitator using authorized banking infrastructure and credit card payment gateways. Mera iLaaka does not act as a trustee or in a fiduciary capacity concerning the transaction or transaction price.

Payment Facility for Buyers/Customers:

You, as a Customer, understand that upon initiating a Transaction You are entering into a legally binding and enforceable contract with the Seller to purchase the products and /or services from the Seller using the Payment Facility, and You shall pay the Transaction Price through Your Issuing Bank to the Seller using Payment Facility.

You, as a Customer, may agree with the Seller through electronic communication and electronic records and using the automated features as may be provided by Payment Facility on any extension / increase in the Dispatch and/or Delivery time and the Transaction shall stand amended to such extent. Any such extension / increase of Dispatch / Delivery time or subsequent novation / variation of the Transaction should be in compliance with Payment Facility Rules and Policies.

You, as a Customer, shall electronically notify Payment Facility using the appropriate Mera iLaaka Platform features immediately upon Delivery or non-Delivery within the time period as provided in Policies. Non-notification by You of Delivery or non-Delivery within the time period specified in the Policies shall be construed as a deemed Delivery in respect of that Transaction. In case of Cash on Delivery transactions, Customer is not required to confirm the receipt of products or services.

You, as a Customer, shall be entitled to claim a refund of the Transaction Price (as Your sole and exclusive remedy) in case You do not receive the Delivery within the time period agreed in the Transaction or within the time period as provided in the Policies, whichever is earlier. In case you do not raise a refund, claim using Platform features within the stipulated time then this would make You ineligible for a refund.

You, as a Customer, understand that the Payment Facility may not be available in full or in part for certain category of products and/or services and/or Transactions as mentioned in the Policies and hence You may not be entitled to a refund in respect of the Transactions for those products and /or services.

The Customer and Seller mutually acknowledge that Mera iLaaka shall not be held liable for any damages, interests, or claims arising from the non-processing or delayed processing of a Transaction/Transaction Price, provided that such events are beyond the control of Mera iLaaka.

Compliance with Laws:

In accordance with applicable law, if the Customer makes a purchase equal to or exceeding INR 2,00,000.00, the Customer must upload a scanned copy of their PAN card on the Platform within 4 days of the purchase. Failure to do so will result in the cancellation of the Customer's purchase. The submission of the PAN card is a one-time requirement, and if submitted once, it need not be resubmitted. The Customer's order will be canceled if there is a discrepancy between the name of the Customer and the name on the PAN Card.

Buyer and Seller are obligated to comply with all applicable laws, including but not limited to the Foreign Exchange Management Act, 1999, the Customs Act, the Information Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, the Prevention of Money Laundering Act, 2002, the Foreign Contribution Regulation Act, 1976, the Income Tax Act, 1961, and the Export Import Policy of the government of India, as well as any rules and regulations issued under these laws. This compliance pertains to their use of the Payment Facility and the Mera iLaaka Platform.

Buyer’s Arrangement with Issuing Bank:

The processing of all valid Credit/Debit/Cash Card and other payment instruments occurs through a Credit Card payment gateway or an appropriate payment system infrastructure. This process is subject to the terms and conditions agreed upon between the Buyer and the respective Issuing Bank and the payment instrument issuing company.

Furthermore, Online Bank Transfers from valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank, which supports the Payment Facility to offer these services to Users. The terms and conditions governing such Online Bank Transfers on the Payment Facility are also as agreed between the Buyer and the respective Issuing Bank.

Governing Law

The Terms of Use are subject to interpretation and construction in accordance with the laws of India, with exclusive jurisdiction in Ranchi.

 Jurisdictional Concerns/Sale in India Only

The material on the Platform is intended for sale in India unless otherwise specified. Mera iLaaka does not assert that the materials on the Platform are suitable or available for use in locations/countries outside India. Users accessing this site from locations/countries other than India do so at their own discretion, and Mera iLaaka is not accountable for product supply or refunds for items ordered from locations/countries other than India. Furthermore, Mera iLaaka does not guarantee compliance with local laws, if applicable.

Profanity Policy

We strictly prohibit the use of racist, hateful, sexual, or obscene language in any public area on the platform. This includes text within listings, on Seller/Vendor pages, and all other site areas visible to Users. If explicit language is part of an item's title, Sellers are permitted to partially obscure the offensive word using asterisks (e.g., s*** or f***).

To report violations:

Report offensive Display Names.

Report offensive language in listings or elsewhere.

If profanity is found in feedback comments, communications between Users, or email exchanges related to platform transactions, refer to Our feedback removal policy and request appropriate action.

Disciplinary measures may range from indefinite or temporary account suspension to formal warnings. We assess alleged violations considering the circumstances and user trading records.

Consequences for policy violations:

Account privilege limitations.

Loss of special status.

Account suspension.

We reserve the right to delete a product review containing offensive language. Additionally, if a review unfairly impacts a product, the platform may remove it and, at its discretion, blacklist the customer from posting further reviews.

In case of suspicion or knowledge of false claims, Mera iLaaka may take various actions, including suspension, blocking, restricting, or canceling the Display Name of the involved buyer/seller. False claims may lead to legal proceedings initiated by Mera iLaaka, with potential civil and/or criminal consequences.

The platform also reserves the right to pursue legal action against Users filing fraudulent claims or providing misleading information. Deliberately submitting false complaints may result in criminal prosecution.

Returns Policy

Definition:

‘Return’ is defined as the action of giving back the item purchased by the Buyer to the Seller on the Mera iLaaka Platform. Following situations may arise:

Defective Item:

If the item received by the Buyer is defective, the Buyer has the right to return the product to the Seller. The Seller is responsible for addressing defects and ensuring the product meets quality standards.

Shipping Damage:

In the event of the item being damaged during shipping, the Buyer can initiate a return. The Seller is expected to take appropriate measures to prevent shipping-related damages, and in case of damage, facilitate the return process.

Missing Products:

If the delivered package lacks the ordered products, the Buyer is entitled to initiate a return. The Seller must ensure accurate packaging and dispatch to avoid missing items.

Wrong Item Sent:

If the Seller dispatches an incorrect item, the Buyer can return the product. Sellers are accountable for shipping the correct items and rectifying any mistakes promptly.

Return Process:

The buyer will go to the physical store of the vendor and will return the purchased item on his own. Mera iLaaka has no role to play in execution of this work.

 

 

Grievance Redressal Mechanism

If you have any grievances, objections, or complaints regarding the Platform, other Users, or the Company, including concerns about the suspension, termination, or blocking of your membership or right to use the Platform, it is advised to promptly raise such issues with the designated Grievance Officer at [email protected]. Ensure to provide all necessary information and/or documents to enable the Company/Grievance Officer to attempt resolving the issue.

The Grievance Officer will try to acknowledge your grievances/complaints within 48 hours of receiving them. The Grievance Officer may request additional information to look into the grievances/complaints and work towards resolving them. The aim is to address the grievance/complaint within 1 month of receiving it. Please note that failure to provide the information requested by the Grievance Officer may hinder the resolution process.

By agreeing to these Terms, you consent and authorize the Grievance Officer to contact you based on the information provided by you for the purpose of addressing the grievance/complaint.

 

Mera iLaaka's List of Prohibited Products (Illustrative List, not exhaustive)

  • Items infringing on privacy, such as spy cameras or other covert surveillance devices.
  • Fake or counterfeit collectibles, artifacts, or historical items.
  • Items encouraging illegal activities or violence.
  • Unregistered pharmaceuticals or medical devices.
  • Items promoting hate speech or discrimination.
  • Stolen or illegally acquired items.
  • Expired or spoiled food items.
  • Human Organs or body parts.
  • Adult Products and Pornographic/Obscene Materials (including child pornography) in any form (Print, audio/video, MMS, images, photographs, etc.).
  • Animals, whether live or dead, including their parts and products.
  • Any article/material/service that cannot be exhibited, advertised, made available, or offered for sale on e-commerce platforms/technology due to restrictions/conditions unless all those conditions are met pursuant to the Applicable Laws.
  • Any article/material/service prohibited by any law at any given time.
  • Any item/material that may assist in the performance of any illegal or unlawful activity.
  • Counterfeit Goods and goods/materials infringing any intellectual property rights.
  • Currency, Negotiable Instruments, etc.;
  • Endangered species of animals and plants, whether alive or dead.
  • Firearms, parts thereof, and ammunitions, weapons, knives, sharp-edged and other deadly weapons, and parts of, and machinery for manufacturing arms. This excludes articles designed solely for domestic or agricultural uses, such as a lathi or an ordinary walking stick and weapons incapable of being used otherwise than as toys or of being converted into serviceable weapons.
  • Financial Services.
  • Grey market products.
  • Hazardous materials including, but not limited to, acid, fireworks, explosives, flammable adhesives, poison, hazardous chemicals, oil-based paint and thinners (flammable liquids), industrial solvents, insecticides & pesticides, machinery (containing fuel), fuel for camp stoves/lanterns/heating elements, infectious substances, etc.
  • Human remains or skeletons.
  • Invoices (including blank, pre-filled, or value-added invoices or receipts) are strictly prohibited on the Site.
  • Liquefied Petroleum Gas cylinder.
  • Maps and literature where Indian external boundaries have been shown incorrectly.
  • Narcotic Drugs and Psychotropic Substances.
  • Government-related items/equipment (like wireless with the frequency used by Police, uniforms of Government officials including but not limited to Police/Army, etc.).
  • Prescription Medicines and Drugs.
  • Racially/ethnically/religiously offensive materials.
  • Radioactive Materials.
  • Reptile skins.
  • Sex Determination Kit.
  • Stocks and Securities.
  • Stolen Properties.
  • Unauthorized Copies of Intellectual Property.
  • Veterinary Drugs for animals.
  • Wildlife and Animal Products.
  • Any other sanctioned or prohibited items as per law.
  • Passports, other government-issued personal documents.
  • Any other items deemed unfit for listing by [email protected].

 

We, may, from time to time modify the Terms and Conditions of Use of our Platform without any prior notification to you. You can access the latest version of these Terms and Conditions at any given time on the site. In the event the modified Terms and Conditions of Use of this platform is not acceptable to you, you can discontinue using the platform and its services. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Terms and Conditions.
